Die Ehe eines Ausländers mit einem Deutschen bzw. einem EU-Bürger weckt bei Ausländerbehörden mitunter Skepsis. Meist sind es größere Altersunterschiede, welche dann zu ausgiebigen Interviews führen.

Die oftmals überraschend angesetzten Fragerunden sollen klären, ob tatsächliche eine „familiäre Lebensgemeinschaft“ besteht. Nicht die Ehe, sondern nur das tatsächlich Zusammenleben begründen nämlich ein Aufenthaltsrecht.

Die Ehegatten werden getrennt befragt. Dazu können sie nicht gezwungen werden, aber viele lassen sich spontan darauf ein. Wenn das Ausländeramt sorgfältig arbeitet, wird dann ein ganzer Fragenkatalog abgearbeitet, um später Widersprüche aufzeigen und eine Scheinehe nachweisen zu können.

Der Fragebogen sieht zum Beispiel so aus:
